Prepare your motion and file the motion with the criminal court clerk.
Send a copy to all parties and the district attorney’s office.
If you file the motion on a Monday or Tuesday, the motion will be heard the first Monday after filing. If you file on Wednesday, Thursday, or Friday, the motion will be heard the following Monday. The docket is called at 9:00 a.m. Example: If a motion is filed on August 5, 2016, the motion is automatically set for August 15, 2016.)
The defendant, the defendant’s attorney, and the state’s attorney are supposed to present at 9:00 a.m. on the day of the hearing.
